Terms of Service

Welcome to BlushDrops. These Terms of Service ("Terms") govern your access to and use of blushdrops.com and any related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What BlushDrops Is

BlushDrops is a non-custodial web3 interface. We provide a way for users to:

• Scan public blockchains for unclaimed airdrops associated with their wallet address
• Claim those airdrops with a single signed transaction
• Swap ERC-20 tokens across multiple blockchains via third-party DEX aggregators
• Access third-party fiat on-ramp services to purchase crypto with cash

2. Non-Custodial

BlushDrops never takes custody of your funds, tokens, or private keys. You maintain full control of your wallet at all times. Every transaction is signed by you from your own device. If you lose access to your wallet or private keys, BlushDrops cannot help you recover it.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction. You may not use the Service if you are located in a country subject to comprehensive sanctions (e.g., North Korea, Iran, Syria, Cuba) or if applicable law prohibits your use of crypto services.

4. No Financial, Legal, or Tax Advice

Nothing on BlushDrops constitutes financial, investment, legal, or tax advice. All information is provided for informational purposes only. You are solely responsible for your own decisions, including any tax obligations that arise from claiming airdrops or swapping tokens in your jurisdiction.

5. Third-Party Services

BlushDrops integrates with third-party providers including Alchemy, Infura, 0x, CoinGecko, MoonPay, Transak, Fonbnk, and others. We are not responsible for the availability, accuracy, security, or practices of any third-party service. Your use of any third-party service is at your own risk and subject to that provider's terms.

6. Risks of Blockchain and Crypto

Using the Service involves significant risk. You acknowledge and accept that:

• Blockchain transactions are irreversible. Once confirmed, they cannot be undone.
• Gas fees, network congestion, and MEV (maximal extractable value) are outside our control.
• Smart contracts may contain bugs. While we use widely-audited contracts where possible, we cannot guarantee they are free of vulnerabilities.
• Token prices are volatile. You may lose all the value you hold.
• Airdrop eligibility is determined by third-party projects, not by BlushDrops. We do not guarantee that any specific wallet will qualify for any specific airdrop.

7. Service Fee

BlushDrops may charge a service fee on claims and swaps (currently 0.5% on swaps, and a finder's fee on some claims). Fees are deducted automatically by smart contracts at the time of the transaction and are disclosed in the interface before you sign.

8. Acceptable Use

You agree not to:

• Use the Service for illegal activity, money laundering, or sanctions evasion
• Attempt to exploit, hack, DDoS, or reverse-engineer the Service
• Use automated tools to scrape or abuse our endpoints
• Impersonate BlushDrops or its team
• Use the Service in any way that violates applicable law in your jurisdiction

We reserve the right to block access from any IP, wallet, or region at our discretion.

9. No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, BlushDrops Labs, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, including lost profits, lost crypto, or lost data, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the greater of (a) 100 USD or (b) the total fees you have paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BlushDrops Labs from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights or applicable laws.

12. Changes to the Service or Terms

We may modify, suspend, or discontinue the Service (or any feature) at any time without notice. We may also update these Terms. The "Last updated" date will reflect changes. Continued use of the Service means you accept the new Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts of Nairobi, Kenya, unless mandatory local law requires otherwise.
